View Full Version : Need legal info about shared files.

I have my shared files system setup in a way that if someone wants to download files from my computer they can do so without my autorization. However. I have files in my shared files direcotry that damage the computer. If someone downloaded thos files to thier hard drive and they opened them could I be held legaly responsable for any damage done to thier computer?

I'm not sure, but I'd think you wouldn't be responsible if you said in an index file or something of the sort, that they are dangerous.

What do you mean "damage the computer"? Like a virus?

Not sure what you mean by "without my authorization..." Is that to say "they're not supposed to, but someone could..." or "people are invited to without having to ask me..." It matters.
If the only way someone could download from your computer is by hacking into it, then no, probably no liability on your part. (But, refer to numerous successfull suits by burglers/thiefs/con-men trespassing and/or in the process of breaking the law for possible liability EVEN in analogous circumstances)
If people are invited to without having to ask, then yes, certainly a tort action for negligence could find you liable. (non-legalese: damn straight you might legally responsible!)
